TERMS AND CONDITIONS


MODEL/CLIENT/AZALEA RELATIONSHIP

The Client is defined as the “end-user” and the Agency is an “Intermediary” as defined in the ATO’s “Superannuation Guarantee Ruling SGR 2005/2”, from point 69.

A contract is created between Client and Artist once a booking is confirmed with the Agency whether written, written and partly oral or wholly oral as stated in the ATO’s “Superannuation Guarantee Ruling SGR 2005/2” point 38.

In accordance with the ATO’s “PAYG withholding for performing artists” guidelines, the Agency is entitled to raise invoices and collect monies on behalf of Artist, as an intermediary, even though the contract exists between Client and Artist.

INSURANCE 

AZALEA Models holds public liability insurance, however it is the responsibility of the client (end user) to ensure they have sufficient workers compensation insurance to cover the model while working for them.  

PAYMENT TERMS

AZALEA MODELS INVOICE TERMS ARE STRICTLY 7 DAYS FROM INVOICE DATE

Any other payment terms must be agreed upon in writing when making booking.

In the event that an invoice goes unpaid, AZALEA Models reserves the right to forward the debt to a debt collection agency. If this occurs, the additional costs of the debt collection agency will be payable by the client.

AGENCY FEE 

All invoices have a 10% (plus GST) Agency Fee on model rates. This fee covers administration and booking costs and is not negotiable.

SUPERANNUATION 

Model fees over $450 will be subject to a 9.5% Superannuation charge.

CANCELLATION OF BOOKING 

The terms below can be negotiable when cancellation is due to weather.

Cancellation less than 24 hours prior to shoot - half of the wage which would have been due is payable.

Cancellation 24-48 hours prior to shoot - 25% of the wage which would have been due is payable.

Cancellation more than 48 hours prior to shoot- no payment required.

These conditions do not apply if engagement is postponed to a later date, as long as we are notified at least 48 hours prior to shoot.

In the event a model is not able to fulfil her duties as booked due to illness, AZALEA Models will not be liable for any loss or expense incurred.  AZALEA will attempt to fill the position to ensure minimal loss to client, however no guarantee is given. 

DUTY OF CARE

When engaging a model the same rules and regulations apply as to any workplace and as such, no bullying, harassment or mistreatment of the models will be tolerated. This applies for all contact with model including fittings/rehearsals or any communication between model and client, whether direct or through a third party.

Mistreatment of models will be reported to relevant workplace departments, models will be removed from the job and no further bookings will be available through AZALEA Models.
